  • How much can I claim for in Small Claims Court?
    The maximum amount you can claim in Small Claims Court is $35,000.00 (not including costs and interest). If what you are owed is more than $35,000, you can still file in Small Claims Court if you are willing to waive the amount over $35,000.
  • I have been served with a Claim - how much time do I have to respond?
    You have 20 days to respond. If you do not file a Defence within 20 days after being served with the claim, the Plaintiff can ask the court to have you “noted in default.” When a defendant is noted in default, the court can assume the defendant admits the allegations in the Claim. After the Plaintiff asks the court to have the defendant noted in default, the Plaintiff can ask the court to order the Defendant to pay what the Plaintiff is asking for. This is called a default judgment.
  • Do I NEED to hire a lawyer or paralegal to represent me in Small Claims Court?
    Many litigants find it helpful to hire a lawyer or paralegal for Small Claims Court, but it is NOT a requirement. You may represent yourself. If you choose to seek legal advice, the team at Small Claims Solutions would be pleased to assist you.
